The local maker of bunk beds named as a defendant in a civil lawsuit filed by the parents of a Little League World Series Utah player who suffered a fractured skull when he fell out of one of the beds said it repeatedly warned the organization to use guard rails and ladders when the beds are lofted.

Easton Oliverson, 12, suffered the injuries including bleeding on the brain when he fell out of the top bunk bed that did not have a railing, according to the negligence and liability lawsuit.

In response, Adam Savoy, vice president of Savoy Contract Furniture, said while the company cannot comment directly about any pending litigation filed in Philadelphia Court of Common Pleas, Savoy’s standard operating procedure when quoting single beds that have bunking capability is adding guard rails and ladders to the quotation.

Moreover, the company quotation states clearly that for the safety and fall prevention, “Savoy strongly recommends the use of guard rails and ladders when beds are bunked or lofted.”

Additionally, the Savoy-made bunk beds have warning labels to each recommending such safety precautions be used under these conditions.

Oliverson has returned home after three operations and battled a staph infection treated by antibiotics, and is suffering seizures, his family lawyer, Ken Fulginiti of Philadelphia, told the media.

The lawsuit also names Little League Baseball Inc. as a defendant.

The suit seeks more than $50,000 for the boy’s care, along with punitive damages.

Little League does not comment on pending litigation, an organization spokesman said.
